SPEEDING TICKETS

Harold Dee knows the penalties and DMV sanctions that await you if you make an uninformed decision regarding a Drunk Driving or DWI arrest or for a Speeding ticket or other traffic ticket matter. Mr. Dee has plea bargained thousands of traffic tickets including speeding tickets in local Village Courts, Town Courts, and City Courts in Westchester County, Rockland County, Putnam County, Dutchess County, Columbia County, Orange County, Sullivan County, Nassau County, and Suffolk County. Speeding trials involve violations of Vehicle and Traffic Law (VTL)1180a, charging unreasonable speed for the conditions, VTL 1180b, for speeds greater than 55 mph, VTL 1180c, for offenses occurring in school zones, VTL 1180d on roads with and requiring posted signage, VTL 1180e, when approaching railroad crossings, and VTL 1180f , when occurring within a "work zone". The work zone speeding tickets are assessed at double fines but not double points. A conviction of VTL 1180f leads to double fines and a second conviction within eighteen months causes license or privilege (out of state motorists) suspension. Please see the speeding section for points attributable to these and other charges. Points are held against you for eighteen months from the violation date, not the conviction date.

Speeding tickets are commonly issued by New York State Troopers in Westchester County on I 684, I 84, I 87 (The Deegan or NYS Thruway), I 95, the Cross Westchester Expressway (I 287), the Sprain Brook and the Taconic Parkway. The Westchester County Police typically write speeding tickets on the Parkways within the County, namely The Hutchinson Parkway, the Bronx River Parkway, the Saw Mill River Parkway, the Cross County Parkway and, like the Troopers, wherever else they observe a violation. Various Town and Village Police write tickets generally for speeds exceeding 30 mph. The DEP Police write tickets for speeding violations around the water shed areas in Westchester County and in surrounding counties. The New York State Park Police will also write traffic and speeding tickets in areas surrounding NYS Parks within the State of New York. This practice is called "poaching" as they infringe on "territory" covered by other police departments.

In PUTNAM COUNTY the New York State Police are joined by the Putnam County Sheriff's Department and local Town and Village Police. Police enforce traffic violations throughout the County but especially on Route I684, Route I84, Route 22, Route 9, Route 6, Routes 311 and 312, and very often on the Taconic State Parkway. TYPES OF LICENSES:

EM - Full Unrestricted License. May require corrective lenses (eyeglasses), hearing aids, wide mirrors, or other operating requirement.

Junior license (youth) and the charge is violating a restriction like home by 9 PM.

Restricted license which is issued after suffering 11 points or three (3) speeding convictions in 18 months. Valid for work, school, and medical for you and household members. The license also allows a three hour weekly time slot for personal errands.

A conditional license allows motor vehicle operation to, from, and during work. It is issued after an alcohol related violation.

A Commercial Driver's License for truckers. The maximum BAC level when operating on a CDL can't be greater than .04. If a CDL holder iis convicted of an alcohol violation the commercial license is suspended one year regardless of what type of vehicle the motorist was operating when stopped.

DRUNK DRIVING IN NEW YORK STATE

 If you are charged with Drunk Driving, DWI, in the State of New York it is a Misdemeanor, a crime! If this is the second time you are charged with a DWI within ten years of a conviction for DWI, you face a Felony charge. If convicted of any Felony (including multiple DWI convictions) you will be required to surrender your law, medical, or other professional license! Are you ready for a career change? DWI PENALTIES

Penalties for DWI include jail and/or probation, loss of driving privileges for up to five (5) years, a lifetime revocation in some instances, mandatory substance abuse counseling, DWI fines in the thousands of dollars plus surcharges, plus NYS DMV assessments starting at $750.00. Sanctions also include a prohibition against driving into Canada. An individual convicted of, or even simply charged with, an alcohol related violation within the last ten years (reflected on your driver abstract) may fly into or take the Amtrak train into Canada or even be a passenger in a vehicle, but may not drive himself or his vehicle into Canada! After three years from your conviction, a fee of approximately $350.00 may be paid to the Canadian Consulate to lift the prohibition against you.

An alcohol conviction also brings increased auto, homeowner, umbrella and keyman insurance premiums, if not dropped all together! THE TRAFFIC VIOLATIONS BUREAU

Non criminal traffic tickets are addressed by the local city, town, or village criminal court in most of New York State.

The New York State DMV Traffic Violations Bureau (TVB) adjudicates non-criminal moving violations issued in certain jurisdictions, including New York City, Buffalo, Rochester, and the five towns of Western Suffolk County. If you receive a traffic ticket in these areas, your case will be heard at an administrative hearing rather than in a local criminal court. There are many rules which make it difficult for motorists who contest a TVB traffic ticket or summons. For example, you cannot plea bargain your case, there is no right to discovery, no supporting deposition are available, hearsay evidence is admissible and many rules of evidence do not apply. Additionally, if you are more than one hour late for a scheduled hearing it could result in a suspension of your operating privileges.

We can provide answers, suggestions and defenses to help your speeding or traffic tickets violation. If you plead guilty to a traffic ticket offense such as speeding or disobeying a Traffic Control Device (VTL 1110a) your auto insurance rates will undoubtedly increase. Many times other protective policies such as Homeowner, Keyman and Umbrella Insurance policy premiums also increase. You will also accumulate points on your New York State driver's license which may lead to additional driver responsibility assessment charges which are three hundred dollars ($300.00) once your point total reaches six (6) points, and an additional $75.00 for every additional point charged against you within the same 18 month period. This new assessment program is applicably to any driver incurring six points in NYS regardless of what state they are licensed in.

In addition, if a New York State driver is convicted of three speeding tickets, all issued in NY within the same 18 month period, the New York State license (or out of state driver privileges) will be revoked for a minimum six months. A restricted license may be available to you if you have not been issued a restricted license within the last three years.
